UX/UI Design & Digital Project Management Consulting Services
1. Introduction & Acceptance of Terms
Welcome to gigiux ("we," "our," "us," or the "Service Provider"). By engaging our professional UX/UI Design and Project Management services, or by accessing our website gigiux.com, you agree to be legally bound by these Terms of Service. If you do not agree with any part of these terms, please refrain from using our website or hiring our services.
2.Scope of Services
We provide end-to-end digital consulting solutions, including but not limited to:
UX/UI Design Services: User research, information architecture, wireframing, interactive prototyping, Design System development, usability testing, and visual interface design.
Project Management Services: Strategic digital roadmap planning, Sprint/delivery management using Agile frameworks (Scrum, Kanban), cross-functional team coordination, and scope management.
The specific scope, deliverables, milestones, and timelines for each engagement will be detailed in an independent Statement of Work (SOW) or Project Proposal executed by both parties.
3. Client Responsibilities
To ensure project success and timely delivery, the Client agrees to:
Provide required brand assets, project information, software access, and feedback in a timely manner within agreed timelines.
Designate a primary point of contact with decision-making authority for milestone sign-offs.
Refrain from requesting work outside the agreed SOW without executing a formal Change Order or budget adjustment.
Ensure that all materials provided to us do not infringe upon third-party intellectual property rights.
4. Payments and Refunds
Financial terms are governed by individual project agreements:
Payment Terms: An upfront deposit (typically 50%) is required prior to project kickoff, with remaining balances due upon milestone completion or final delivery.
Revisions: Each deliverable includes a specified number of revision rounds (typically two rounds). Scope additions or structural changes requested after approval will be billed separately.
Project Pauses & Delays: Payment delays or client-side inactivity exceeding 15 business days may result in project suspension and timeline renegotiation.
5. Intellectual Property
Ownership of work product is managed as follows:
Preliminary Works & Concepts: The Service Provider retains all rights to unused concepts, preliminary drafts, and unselected design files.
Final Deliverables: Upon receipt of payment in full, all proprietary rights to the final UX/UI designs and project documentation are assigned to the Client.
Portfolio Rights: The Service Provider retains the right to display completed project assets, case studies, and role descriptions on gigiux.com and professional channels, respecting non-disclosure obligations.
6. Limitation of Liability
Both parties agree to protect and keep confidential all proprietary business insights, user data, strategic roadmaps, and technical specifications disclosed during the course of the engagement. This obligation survives project termination.
7. Termination
Either party may terminate the engagement by providing a written notice at least seven (7) days in advance. Upon termination, the Client shall pay for all billable hours and completed milestones up to the date of notice.
8. Changes to These Terms
We reserve the right to modify these Terms of Service at any time. The current version will always be published on gigiux.com or attached to active Statements of Work.
9. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the Autonomous City of Buenos Aires (CABA), Argentina. Any legal dispute shall be resolved in the competent courts of CABA, except for international client engagements, where governing law and jurisdiction may be explicitly specified otherwise in the governing SOW or master contract.
